Commercial law Law Of Delict Contractual law Employment legislation (BCEA, LRA) ICASA POPI BBBEE in the ICT Sector Skills: Excellent negotiation skills Commercial acumen Excellent written and verbal communication skills Behavioral: Attention to detail Accurate Deadline driven Initiative Ability to prioritise Judgement Stress tolerance Team player Minimum Qualification: LLB, LLM, must be an admitted attorney In-depth knowledge and understanding of relevant legislation in ICT sector (local and international) Minimum Experience: 5 to 8 years related experience post admission in corporate IT/ telecommunications sector experience will be an advantage Other Requirements: Own transport Job Grade D4: Key Stakeholder Relationships Internal Exco Heads of Department External Customers Suppliers Attorneys Regulatory bodies Key Performance Areas & Indicators Negotiate and Manage Commercial Contracts Draft and review all commercial and legal contracts or SLA agreements and advise on legal risk - Identify, assess and manage legal & commercial risk Monitor all legal agreements and ensure consistency within legal standards - Mitigate commercial and legal risk Identify opportunity for improvement Lead negotiations on all Contracts to ensure best commercial outcome for the company - Highlight commercial and legal risks to CFO/Exco if material in nature Assist CFO in drafting new commercial agreements, as and when required - Ensure material legal and commercial risks are addressed Regulatory Compliance in jurisdictions where the company has an entity Understand legal issues in countries where the company has a legal presence. - Ensure the company is compliant with all relevant legislation Support business to resolve any legal / compliance issues that arise in a jurisdiction - Recommend effective course of action to avoid risk - Implement agreed interventions Support CFO to draft any agreements / correspondence required in a particular Country - Ensure material legal and commercial risks are addressed Obtain expert opinion on specialist areas of law - Manage costs - Timely, professional advice Telco compliance in countries where the company offers services Ensure the company understands Telco regulations in countries that it offers Telco services - Timely, professional advice Discuss and correspond with in-Country Regulators where required - Protect the company from legal action Engage in-country attorneys where required, to determine how to keep the company legally compliant in each country - Business sustainability and risk mitigation Assess regulatory risk per country and communicate to CFO/Exco - Identify legally and commercially compliant solutions Manage BBBEE scorecard Ensure up to date knowledge of BBBEE legislation - Achieve and maintain agreed BBBEE Level for the company Assist CFO to design legal structures and agreements that maximize the Companys BBBEE rating - Provide guidance on implementation of BBBEE strategy and manage implementation Management Reporting Develop a risk register highlighting legal and commercial risks within the Company. - Accurate feedback - Escalate to CFO and Exco when appropriate
